Workplace injuries

May 7th, 2013 at 3:01 pm

Depending on your job, you may be in more or less danger for a workplace injury that will vary in type and severity, but it is important for everyone to know what to do should something happen. The most important thing to do in the event on an injury is also to get medical help. After taking care of medical needs, follow these steps to properly file an injury claim:

LucyReport the injury to your employer as soon as you can. There is a 90 day window in which you can report an injury before you run the risk of losing your benefits. There are, however, two years in which you have time to file a claim after the injury has taken place. It is most important to report the incident. If someone dies, the family also has two years to file the claim to receive death benefits from the employer.

Filing a claim is the next step, with which you should consult an attorney. There are also certain actions to be taken if your employer does not report to injury or denies you your benefits. Employers are required to have workers’ compensation insurance and are required to pay when a claim is filed, so there is no reason for them to fight you.

Your compensation rate is the compensation that you are entitled to for the amount of time that you must miss work due to your injury. It is dependent upon your average weekly wage, but cannot be more than the maximum week wage possible. You will begin to receive this compensation after you have missed work for seven days. If you miss more than 14 days, however, your compensation will also include the first seven days that you missed. Any and all of your benefits will immediately stop when your doctor releases you to work.

If you or a family member of yours has been injured at work, it is important to know these steps and information about what to do and how workers’ compensation works for injuries. If you need further assistance to take action in your case, contact a workers’ compensation attorney in Cook County. Attorneys at the Law Office of Francis J Discipio will help you in your case today.
