For many new parents, having a baby is a source of joy. However, when a new mother or her infant child is injured during birth, elation can turn into despair. If you or a loved one are involved in such a situation, you may be wondering what went wrong. Unfortunately, hospitals and their staff may not be forthcoming, especially if medical negligence and malpractice are involved.

The medical malpractice attorneys at the Law Offices of Francis J. Discipio can help you determine what your legal choices are and if medical malpractice occurred at the time of your child's birth.

Types of Birth Injuries

There are many different forms of birth injury. Some of the most common birth injuries include:

  • Cerebral palsy. Trauma, infections, or asphyxiation during birth can cause the death of brain cells, adversely affecting a child’s muscle control, coordination, reflexes, and balance.
  • Caput succedaneum. This injury causes the tissues of the baby’s scalp to swell. You may see bruising on the baby’s scalp, but the bruising is most likely to disappear after a few days.
  • Brachial palsy. Brachial Palsy occurs when the nerves that aid the arms and legs are injured. This is usually the result of difficulty in delivering the baby’s shoulder during childbirth. Brachial palsy makes the baby lose his or her ability to rotate the arms. If the nerves are torn, it may lead to permanent nerve damage.
  • Facial paralysis. Facial paralysis occurs when pressure is applied to the baby’s face or when forceps (surgical instrument) are used during delivery. Your baby may be unable to close his or her eye(s) and move his or her facial muscles. If the nerves were torn, surgery may be needed.

These injuries are not to be taken lightly because they may lead to permanent damage. However, treatment for these injuries could come with hefty fees attached. If you or a loved one has an infant child who was injured during birth and requires medical treatment for the injuries, contact one of our medical malpractice attorneys at the Law Offices of Francis J. Discipio. We can help recover the costs for any medical services that your young child may need due to an injury sustained from birth.

Causes of a Birth Injury: Was It Malpractice?
